HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO. 561 OF 2015 ORDER:

The petitioner/accused seeks to quash the docket order dated 17.9.2014 in Crl.M.P.No. 973 of 2014 in C.C.No. 102 of 2013 on the file of Special Judge for Economic Offences -cumVIII Additional Metropolitan Sessions Judge at Hyderabad, whereunder the learned Judge dismissed the recall petition filed under Section 70 (2) Cr.P.C for recall of the NBW issued against him.

During the course of hearing, learned counsel for petitioner submitted that the petitioner/accused will appear before the Court, prayed for ordering the recall of the NBW. In pursuance of the said submission, this Criminal Petition is allowed and the petitioner/accused is directed to appear before the Special Judge for Economic Offences -cum- VIII Additional Metropolitan Sessions Judge, Hyderabad on or before 19.2.2015 and on his appearance, the learned Judge shall recall the NBW issued against him.

The petitioner/accused shall thereafter appear regularly before the Trial Court and assist the Court in completion of the trial.

As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
