HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO TRANSFER CRIMINAL PETITION No.156 OF 2015 ORDER:

This Criminal Petition is filed by the petitioner under Section 407 Cr.P.C seeking to transfer Crl.M.P.No.1340 of 2015 in M.C.No.4 of 1993 on the file of Additional Junior Civil Judge, Repalle, Guntur District to Additional Metropolitan Sessions Judge for the trial of Jubilee Hills Car Bomb Blast Case-cumAdditional Family Court, Hyderabad. Heard the learned counsel for the petitioner and the learned Public Prosecutor (Andhra Pradesh) for the State before notice to respondent No.2 and before admission. Perused the material on record.

There are no grounds to transfer the above said case for nothing shown within the purview of Section 407 Cr.P.C. so far as petitioner is concerned but for to say remedy is left open to the petitioner to file an application under Section 126(2) Cr.P.C. before the learned Magistrate along with the disability certificate, though capable of attending the duties at Hyderabad expressing inability to physically present before the trial Court at Repalle, Guntur District, after notice to the Public Prosecutor concerned and the learned Magistrate shall hear and pass appropriate orders to dispense with the personal appearance of the petitioner subject to conditions of personal appearance, as and when required during trial.

Accordingly, this criminal petition is disposed of. Miscellaneous petitions pending if any, shall stand closed.
