ORDER:

The petitioner claims to be the owner of Plot No.40 in Survey No.140 of Kukatpally Village, admeasuring 240 square yards. The petitioner claims that he has submitted an application for grant of permission to construct a building which was received on 19.12.2013 and also on 23.12.2013 during the Praja Vani Programme, but no orders are passed on the said building application. On account of the inordinate delay, grave prejudice is caused to the petitioner. Hence, this writ petition.

2. Learned Standing Counsel, on instructions, submits that no proper building plan was submitted by the petitioner and the relevant building plan fee was not paid and, therefore, the question of processing such application would not arise and if the petitioner submits an application now in proper form by enclosing all the relevant documents and the requisite fee, the same would be attended to on a priority basis.

3. Having regard to the submissions made by the learned Standing Counsel, the learned counsel for the petitioner submits that the petitioner would be advised to submit a fresh application enclosing all the relevant documents including the payment of requisite fee.

4. Having regard to the said submissions, the Writ Petition is disposed of granting liberty to the petitioner to make an application in accordance with the procedure envisaged along with relevant enclosures and requisite fee. As and when such an application is made by the petitioner, the same shall be considered and appropriate orders be passed by the competent authority i.e., the Deputy Commissioner, Kukatpally Municipal Office, Hyderabad (3rd respondent). Such a decision shall be taken within a period of three

(3) weeks from the date of receipt of the application. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
