HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.4513 of 2015 ORDER :

This is a petition seeking bail for the petitioner-accused who is alleged to have committed offences punishable under Sections 365 IPC, Section 10 and 11 of Child Marriage Restraint Act, Section 3 and 4 of Dowry Prohibition Act, r/w.34 IPC in Crime No.02 of 2015 of Malkipuram Police Station, East Godavari District. Heard both sides.

Perused the material on record.

The case of the prosecution, in brief is that on 02.01.2015 the de facto complainant lodged a report against the petitioner and another alleging that the petitioner eloped her daughter to Chennai who is a minor and got married. The petitioner dropped the daughter of de facto complainant at her house and to take back after attaining majority. After attaining majority when the de facto complainant along with the elders went to the house of the petitioner, the petitioner and his father demanded for dowry. Basing on the said complaint the above case is registered. The contention of the learned counsel appearing for the petitioner is that a false case has been foisted against the petitioner due to political rivalry and that he is being subjected to unnecessary harassment in view of the pendency of the crime and he is apprehending arrest at the hands of the police under the influence of the complainant.

Taking into consideration of the gravity of the offence, the manner in which it is committed and the surrounding facts and circumstances and the fact that investigation is still pending, it is not desirable to release the petitioner/accused on bail at this juncture. There are no merits in the petition and the same is liable to be dismissed.

Criminal Petition is accordingly dismissed.
