THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.31531 of 2016 ORDER:

This Writ Petition under Article 226 of the Constitution of India is filed seeking the following relief:

" ..

to issue a Writ, Order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondents 3 and 4 in not allowing the Petitioner to cut and transport Eucalyptus trees from the farmers land to various factories as illegal, arbitrary, contrary to the provisions of Andhra Pradesh Preservation of Private Forest Rules, 1978 and opposed to principles of natural justice and is violative of Rights guaranteed under the Constitution of India and consequently direct the Respondents to allow the Petitioner to cut and transport Eucalyptus trees raised by the farmers in their patta lands in ArakuvalleyMandal, Munchangiput-mandal, Paderu-Mandal, Pedabayalu Mandal, Kukumpet Mandal and Dumbrigude Mandal of Visakhapatnam-District, and pass such other order or orders as this Hon'ble Court deems fit and proper in the interests of justice."

It is submitted by the learned counsel for the petitioner that the issue raised in the present writ petition is squarely covered by the order passed by this Court in W.P.No.10739 of 2013 dt.12.04.2013. A copy of the same is also placed on record along with the writ petition as material papers.

Following the above said order and for the reasons recorded therein, this Writ Petition is also disposed of in terms thereof. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
