THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.40913 OF 2017 ORDER:

Heard counsel for petitioner and the Assistant Government Pleader (Social Welfare).

The petitioner canvasses the grievance of inaction of 2nd respondent in entertaining and passing orders in suit filed on 24.8.2017 along with interim applications as illegal, arbitrary and unconstitutional. The Assistant Government Pleader, after perusing the prayers in the suit and I.A., submits that there ought not to be any reason for not proceeding with the suit/interim application. As the prayer is limited to inaction, he submits that the Court considers issuing directions to 2nd respondent. Statement placed on record.

Writ Petition is disposed of with the following direction: 1) The petitioner is given liberty to file memo by enclosing a copy of this order.

2) The 2nd respondent is directed to take up I.A. filed on 24.8.2017, consider the prayers within four weeks from the date of filing of memo and pass orders.

Miscellaneous Petitions, if any, filed in this Writ Petition shall stand closed.
