THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1721 OF 2016 ORDER:

This petition is filed by the petitioner-accused seeking to quash the proceedings against him in C.C.No.1017 of 2015 on the file of the 5th Additional Judicial Magistrate of First Class, Nellore.

Heard.

It is alleged that the petitioner along with other accused committed the offence punishable under Sections 448, 342, 506 and 323 r/w 34 IPC. His name was included in the charge sheet as alleged accused and notices were issued to him. Considering the facts and circumstances of the case, this Court is not inclined to interfere with the proceedings in the above C.C.

At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the Court below.

In view of the request made by the learned Counsel for the petitioner, the presence of the petitioner before the Court below is dispensed with, except on the dates when his presence is insisted by the Court below.

With the above direction, the Criminal Petition is disposed of. Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
