ORDER:

The grievance of the petitioner, who claims to be the neighbour of respondent No.3, is that the latter has been raising construction in deviation of the sanctioned plan by not leaving proper set backs causing great inconvenience to him. Mrs.P.Laxmi, learned standing counsel for the Greater Hyderabad Municipal Corporation (GHMC) appearing for respondent No.2, on oral instructions, submitted that as soon as the illegal construction undertaken by respondent No.3 has come to the notice of respondent No.2, action is initiated and notices under Sections 452 and 461 of the Greater Hyderabad Municipal Corporation Act, 1955 (for short 'the Act'), are being issued. She has assured that appropriate action for prevention of further construction by respondent No.

3 will be taken immediately besides taking action for the construction already raised in deviation of the sanctioned plan. In the light of the above submissions of the learned standing counsel for GHMC, the Writ Petition is disposed of with the direction to respondent No.2 to ensure that respondent No.3 raises construction strictly in accordance with the sanctioned plan and without any deviations.

As a sequel to disposal of the writ petition, W.P.M.P.No.47743 of 2015 filed by the petitioner for interim relief shall stand disposed of as infructuous. _________________________ C.V.NAGARJUNA REDDY, J 16th November, 2015 GHN
