Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies-respondents.

2. This writ petition is filed seeking writ of Mandamus declaring the inaction of the 3rd respondent in not issuing duplicate authorisation to the petitioner's fair Price Shop No.20 at Dadipalli Village, Manchal Mandal, Ranga Reddy district, by renewing it on payment of fee and not permitting the petitioner to do the fair price shop business as it is, illegal and arbitrary.

The petitioner is the Fair Price Shop dealer of Shop No.20 at Dadipalli Village, Manchal Mandal, Ranga Reddy District and has been discharging the duties as fair price dealer for the last 30 years. Earlier, on the allegation that petitioner committed certain irregularities, an enquiry was held and final orders were passed on 18.10.2012 by the 3rd respondent imposing penalty on the petitioner. The version of the petitioner is that he paid penalty and has been discharging duties as fair price shop dealer. On the other hand, it is submitted by the learned Government Pleader for Civil Supplies that the petitioner's authorisation was expired on 31.03.2012 and the petitioner has not made any application for renewal of the authorisation. As the authorisation of the petitioner was expired, the authorities have tagged the cardholders to the neighbouring fair price shop.

4. It appears that recently the petitioner filed an application for renewal of the authorisation, which is now pending with the 3rd respondent. Under these circumstances, the writ petition is disposed of directing the 3rd respondent-Revenue Divisional Officer, Saroornagar Division, Ranga Reddy District, to pass appropriate orders on the

application submitted by the petitioner for renewal, within a period of eight (8) weeks from the date of receipt of a copy of this order. Miscellaneous applications, if any, shall stand closed. No order as to costs.
