THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2445 of 2016 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/accused in C.C.No.1526 of 2015 pending on the file of X Additional Chief Metropolitan Magistrate, Secunderabad, arising out of Crime No.333 of 2015 of Gandhinagar Police Station, Hyderabad, registered for the offences punishable under Sections 324 IPC.
Heard the learned counsel for the petitioner/accused and the learned Public Prosecutor and perused the material available on record.
After arguing for sometime, the learned counsel for the petitioner, while not pressing for the main prayer, confined his argument only to the extent of dispensing with the presence of the petitioner before the trial Court.
In any event, considering the facts and circumstances of the case, the presence of the petitioner/accused before the trial Court is dispensed with except on the dates when their presence is essentially required by the Court and the petitioner shall be properly represented by his counsel.
With the above observation, this criminal petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
