THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO Writ Petition No.37120 of 2015 O R D E R :

The grievance of the petitioner in this Writ Petition is that pursuant to the show cause notice dt.06.12.2014, an order of suspension pending enquiry has been issued on 30.09.2015 by the 2nd respondent suspending the petitioner's Fair Price Shop dealership authorization and that the said suspension has not been followed up by any enquiry as per the provisions of the A.P. Scheduled Commodities Dealers (Licensing Storage and Regulation) Order, 2008 (for short 'Control Order').

2. Petitioner contends that the action of the respondents in continuing the suspension without commencing and concluding the enquiry against him under the Control Order is arbitrary and illegal.

3. The learned Government Pleader appearing for respondents states that the 2nd respondent will conclude the enquiry by 30.12.2015.

4. Having regard to the said submission, this Writ Petition is disposed of directing the 2nd respondent to complete the enquiry initiated against the petitioner under the provisions of the Control Order pursuant to the show cause notice dt.06.12.2014 issued to the petitioner, on or before 30.12.2015. There shall be no order as to costs.
