HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.4858 OF 2016 ORDER:

The present Civil Revision Petition under Article 227 of the Constitution of India is filed questioning the order dated 11.08.2016 in I.A. No.628 of 2016 in O.S. No.270 of 2009 passed by the Additional Senior Civil Judge, Tirupat, whereby the petition filed under Order XVIII Rule 17 read with Section 151 of the Code of Civil Procedure, 1908, seeking to recall PWs.1 and 2 for the purpose of cross examination on behalf of the 2nd defendant by reopening the evidence for proper and better adjudication. was dismissed.

2. As per the material placed before this Court by the registry, the original suit bearing No.270 of 2008 itself was disposed of on 13.11.2017, hence, the cause in the revision petition does not survive for adjudication..

3. Therefore, the Civil Revision Petition is dismissed as infructuous. No order as to costs.
