THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1459 OF 2016 ORDER:
1. This revision is filed by the petitioner-accused aggrieved by the order dated 10.5.2016 passed in Crl.M.P.No.1101 of 2016 in Crime No.76 of 2016 by the II Additional Chief Metropolitan Magistrate, Hyderabad.
2. The petitioner-A1 in the above Crime filed the above Crl.M.P. for release of the seized premises and for interim custody of 71 barrels of lubricant oil seized in the above crime. The learned Magistrate allowed the above Crl.M.P., and ordered to return 71 oil barrels to the petitioner on condition of the petitioner executing a self bond for Rs.4,00,000/- with one surety for the like sum. The Court below has not passed any orders in connection with the release of the premises. Aggrieved by the order of the learned Magistrate, the petitioner filed this revision.
3. Heard and perused the material available on record.
4. The learned Additional Public Prosecutor opposed this revision.
5. From the material on record, it is obvious that no orders were passed by the Court below with regard to release of the premises seized in the above crime.
6. Considering the facts and circumstances of the case, this Court is inclined to pass the following order:
(i) The condition imposed by the learned Magistrate directing the petitioner to execute a self bond for Rs.4,00,000/- with one surety for the like sum is modified as follows: "The petitioner shall execute a self bond for Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like sum."
(ii) Further, in view of the return of property, the Court below/authority concerned is directed to hand over the premises seized in the above crime to the petitioner.
7. Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
