HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.52 of 2014 ORDER :

This petition is filed to withdraw O.P.No.93 of 2013 from the file of Principal Senior Civil Judge, Rajahmundry, and transfer the same to the Courts at Khammam, having competent jurisdiction, for disposal in accordance with law.

2. Petitioner is wife and according to her affidavit, her marriage with respondent-husband was performed on 31.08.2007 at Sri Stambadri Lakshminarasimhaswamy Devastanam (Gutta), Khammam and that she was driven out of the matrimonial home in the month of February 2010 and from that time she is taking shelter at her parents' house in Khammam and living on mercy of their parents. She stated that respondent filed O.P. before Principal Senior Civil Judge, Rajahmundry, for divorce and that it is difficult for her to travel a distance of 200 KMs. for the purpose of defending the said O.P. She contended that she has no assistance to escort her from Khammam to Rajahmundry and that her father is a senior citizen, aged about 62 years and that she has no financial capacity and for these reasons, she prayed for transfer of O.P.No.93 of 2013 from Rajahmundry to Khammam.

3. Other side has not filed any counter disputing the affidavit averments.

4. Heard arguments.

5. Advocate for petitioner submitted petitioner filed M.C.No.21 of 2014 and the same is pending before Family Court, Khammam and that this O.P. can be transferred to Family Court, Khammam, so that both the matters can be tried together.

6. Considering the reasons stated in the affidavit and also considering submissions of advocate for petitioner, O.P.No.93 of 2013 is withdrawn from Principal Senior Civil Judge, Rajahmundry, East Godavari and transferred to Family Court, Khammam, to be tried along with M.C.No.21 of 2014.

7. Accordingly, transfer C.M.P. is allowed. No costs.

8. Miscellaneous Petitions, if any, shall stand closed. __________________ S. RAVI KUMAR, J 19th February 2015.
