Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.
2. The present Criminal Petition is filed by the petitioner/A.1 under Section 438 Cr.P.C., seeking release in the event of his arrest in Crime No.491 of 2016 of Uppal Police Station, Cyberabad, registered for the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act.
3. The case of the prosecution is that the marriage of the informant with the petitioner/A.1 was solemnized on 10.06.2015. At the time of marriage, her parents gave Rs.8,50,000/-, 25 tulas of gold, a house admeasuring 100 yards at Chiluka Nagar, Uppal along with household articles. On 14.06.2015 her father-in-law (A.2) and her sister-in-law went to Delhi along with her gold and on the next day, they informed that the gold of the informant and her mother-in-law was missing. Upon which, her father lodged a report at Delhi Airport. Subsequently, she went to Delhi along with A.1 and A.3, where she came to know that the gold was not missing, which was informed to her father. Thereafter, all the accused started harassing her physically and mentally to bring additional dowry of Rs.5,00,000/-.
In spite of convening panchayats before elders, the accused did not change their attitude and with that demand, A.1 brought her to Secunderabad from Delhi, left her and went away. Basing on these allegations, the present case came to be registered.
4. Learned counsel for the petitioner submits that the allegations levelled against the petitioner are false and invented for the purpose of this case.
5. Having regard to the nature of offences alleged, the petitioner shall surrender before the concerned Court and move an application for bail after giving prior notice to the Public Prosecutor, in which event the same shall be considered and disposed of, in accordance with law, on the very same day.
