HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Crl.P.Nos.7791 and 7792 of 2015 COMMON ORDER:

These Criminal Petitions are filed by the self-same petitioner/A.2 to cancel or recall the Non Bailable Warrants(N.B.Ws.) issued against him dated 03.02.2015 in C.C.No.163 of 2010(Crl.P.No.7791 of 2015) and in C.C.No.162 of 2015(Crl.P.No.7792 of 2015) on the file of the Special Magistrate, Dharmavaram, Anantapur district, filed by the selfsame 2nd respondent/defacto-complainant.

2. Heard the learned counsel for the petitioner/A.2 so also the learned Public Prosecutor representing State-1st respondent before ordering notice to the 2nd respondent/defacto-complainant and perused the material on record in both the cases.

3. It is the grievance of the petitioner that after the case is transferred from one Court to another there is no fresh summons issued but the N.B.Ws.

4. Having regard to the above, instead of keeping the matter pending and staying proceedings, these Criminal petitions are disposed of directing the petitioner to appear before the trial Court and file an application to recall the warrants for which the learned Magistrate to recall the warrants on the same day subject to execution of a bond under Section 88 of Cr.P.C.by the petitioner with an undertaking of his due appearance for future adjournments to proceed further by the learned Magistrate with the case. Consequently, miscellaneous applications, if any, pending in these Petitions shall stand closed.
