THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12374 of 2015 ORDER:
This Criminal Petition is filed by the petitioner-Accused No.6 under Sections 437 and 439 Cr.P.C. seeking to grant bail to him in Crime No.215 of 2015 on the file of Bheemunipatnam Police Station, Visakhapatnam District, registered for the offence punishable under Sections 363, 376, 354, 343, 506 r/w 34 IPC and Section 4 of POCSO Act.
Heard and perused the material available on record. It is stated in the complaint that the victim-girl left their house on the ground that her mother scolded her. While she was waiting at bus stop, A1 took her to different places, he took her to a room in a place where three persons viz., Sumanth Chowdary, Chandu, and Sampath, and A1 took her into a room and had forcible sexual intercourse with her. A3 touched her body parts. A2 tried to commit rape on her. Subsequently, she went along with three persons viz., A5 to A7. It is alleged that A5 had forcible intercourse with her, A6 and A7 used to come into room and shamed her.
Learned Public Prosecutor submitted that the bail application filed by co-accused was dismissed and the case against the petitioner is on the same footing as that of co-accused, whose bail application was dismissed earlier. Considering the gravity of the offence alleged against the petitioner, this Court is not inclined to grant bail to him.
