THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2452 of 2016 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/A-1 and A-2 in C.C.No.869 of 2015 pending on the file of IX Additional Chief Metropolitan Magistrate, at Nampally, Hyderabad, arising out of Crime No.178 of 2015 of Narayanaguda Police Station, Hyderabad registered for the offences punishable under Sections 354, 448, 506 and 323 IPC.
Heard the learned counsel for the petitioners/A-1 and A-2 and the learned Public Prosecutor and perused the material available on record.
After arguing for sometime, the learned counsel for the petitioners, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court.
In any event, considering the facts and circumstances of the case and also in view of the fact that the identity of the petitioners/ A-1 and A-2 is not denied or disputed, the presence of the petitioners/A-1 and A-2 before the trial Court is dispensed with except on the dates when their presence is essentially required by the Court for the purpose of examination under Section 239 Cr.P.C. and also for examination under Section 313 Cr.P.C. and the petitioners shall be properly represented by his counsel on all hearing dates.
With the above observation, this criminal petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
