THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5103 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking grant of anticipatory bail in connection with crime No.10 of 2015 on the file of the Mahila P.S., Anantapur, registered for the offences under Sections 498-A, 494, 326, 506 read with Section 34 IPC and Section 4 of the Dowry Prohibition Act.

Heard and perused the records.

The allegation against the petitioner is that he, along with his relatives, harassed the complainant and as such, the case is registered against the petitioner along with others. It is also alleged that the petitioner got second marriage without the knowledge and consent of the petitioner. Learned counsel for the petitioner submits that the petitioner has not married another lady and he has not committed any offence, as alleged by the prosecution.

The case is arising out of matrimonial disputes, and as such, if the petitioner is arrested, it would cause prejudice for the parties for amicable settlement in future.

Having regard to the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner herein. In the circumstances, the petitioner/A.1 is directed to surrender before the Magistrate concerned within a period of fifteen days from today and on such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the Magistrate concerned. Further, the petitioner/A.1 is directed to report before the Station House Officer concerned as and when required.
