THE HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.7174 of 2016 ORDER:
Petitioner-A.2 seeks anticipatory bail under Section 482 of the Code of Criminal Procedure in connection with crime No.129 of 2016 of Karimnagar-I Town Police Station, Karimnagar District registered for the offence punishable under Sections 420 and 409 of Indian Penal Code.
According to prosecution, A.1 and petitionerA.2, who worked as Junior Assistant and Shroff in the office of Joint Sub-Registrar-I RO Karimnagar, misappropriated an amount of Rs.70,76,926/- during the period 23.11.2013 to 26.08.2015 by embossing franking impressions through machine maintained in the said office with different kinds of stamps on different dates and by not remitting the amounts into the account of Joint Sub-Registrar-I for transmitting to the Government's account.
Investigation is under progress.
Hence, the present bail application by petitioner-A.2.
Heard both sides.
It is seen, the offence alleged against the petitioner and another accused is of misappropriation of huge amount running into lakhs and the investigation is still in progress.
Learned Public Prosecutor submits that another accused is in abscondance.
In these circumstances, it is not a fit case to grant anticipatory bail. Hence, the petitioner-A.2 is directed to surrender before the Additional Judicial Magistrate of First Class, Karimnagar, and seek a regular bail, in which event, the said Court shall dispose of the said bail application on merits, positively on the same day.
With above observations, the Criminal Petition is dismissed.
