HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6402 of 2015 ORDER:
This petition is filed by the petitioner-accused No.3 under Section 438 Cr.P.C. seeking anticipatory bail in CC No.1045 of 2002 on the file of the X Additional Chief Metropolitan Magistrate, Secunderabad, for the offences punishable under Sections 465, 468, 469, 471 and 420 read with 34 IPC.
Heard and perused the material available on record. The de facto complainant filed a private complaint stating that the petitioner, in collusion with A1 and A2, cheated the de facto complainant by impersonating one M. Krishna Murthy as the de facto complainant and obtained contract of cycle/scooter parking at Secundeabad Railway Station.
Learned counsel for the petitioner submitted that after completion of investigation, the police filed charge sheet before the Court below by showing the petitioner as absconding and hence, the Court below has issued NBW against the petitioner, and the petitioner is ready and willing to abide any conditions imposed by this Court. In the circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. However, taking into consideration the submissions made by the learned counsel for the petitioner, this Court is inclined to pass the following order: The petitioner - accused No.3 is directed to surrender before the X Additional Chief Metropolitan Magistrate, Secunderabad and file an application to recall the NBW issued against him. On filing of such application, the learned Magistrate is directed to recall the warrant issued against the petitioner on his executing a personal bond of a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties
for the like sum each. The petitioner is directed to attend the trial Court on all hearing dates.
