Syed Afzal Ahmed v. The State Of Telangana
HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 37651 of 2018 ORDER:
The present writ petition came to be filed seeking the following relief:
" to declare the action of the respondent No.2 in not granting stay, pending revision preferred against the orders dated 12.07.2018 in Rc.No. G/ 4601/ 2016 passed by the 3rd respondent."
2.
The grievance of the petitioner is that though he filed a revision under Section 9 of the R.O.R. Act, challenging the order dated 12.07.2018 passed by the Revenue Divisional Officer, Mancherial, no orders are passed in the said revision, till date. He also submits that along with the revision, he filed a stay application, which is also pending consideration. According to the petitioner, there is every likelihood of changes being made in the revenue records.
3.
Learned Government Pleader would submit that since the petitioner has filed a stay application along with the revision, the Joint Collector may be directed to pass appropriate orders in the stay application, at the earliest.
4.
Having regard to the facts and circumstances of the case, the Joint Collector is directed to dispose of the interim stay application filed by the petitioner along with the revision, in accordance with the procedure contemplated under law, and pass
orders, within a period of three to four weeks from the date of receipt of a copy of this order, after hearing all concerned. Till such time, status quo as on today to be maintained with regard to the entries in the revenue records.
5.
With the above direction, the writ petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _________________________ JUSTICE C. PRAVEEN KUMAR 12.10.2018 DMG
