In suit for injunction simplicitor, the defendant sought for appointment of an Advocate Commissioner to divide the property for the purpose of fixing up the plaint schedule property. In a suit for injunction, the issue to be decided is who is in possession of property based on evidence available on record and question of appointment of an Advocate Commissioner to divide the property and to determine the suit schedule property, would not arise and it amounts to collecting of evidence and the trial court has rightly dismissed the application and I do not find any reason to interfere with the same and the revision is accordingly dismissed.
