The grievance of the petitioner is that he filed appeal along with stay petition before the 2nd respondent on 29-08-2016 against the impugned proceedings dated 12-08-2016, whereby authorization of fair-price shop of the petitioner was cancelled by the 3rd respondent-Revenue Divisional Officer. As no orders are passed in the said appeal, the present writ petition is filed.
Learned counsel for the petitioner submits that though this Court remanded the matter to the 3rd respondent earlier when cancellation orders were passed, but without considering the same basing on the orders passed by the Joint-Collector under Section 6-A Essential Commodities Act passed the impugned order of cancellation.
Heard learned Assistant Government Pleader for Civil Supplies.
In view of above facts and circumstances, the 2nd respondent is directed to dispose of the appeal filed by the petitioner within a period of eight weeks from the date of receipt of a copy of this order. Till the disposal of
the appeal, operation of the impugned proceedings, dated 12-08-2016 is suspended.
With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
