Heard.

The petitioner, who is 76 years old, has a grievance against his two sons viz., respondents 6 and 7, who stated to have obtained pattadar passbooks with respect to the land of the petitioner, which was purchased by him under a Document No.982/1977, dated 22-061977. The petitioner states that without his consent, the pattadar passbooks have been issued in favour of respondents 6 and 7. So far as the 7th respondent is concerned, he is stated to have filed an agreement on non-judicial stamp paper before the 5th respondent on 02-12-2014 and he is also stated to have given sworn statement, wherein he has stated that he has no objection for cancelling pattadar passbooks standing in his name and transferring the same in the name of his parents.

However, the 6th respondent is stated to have not agreed for transferring the land in question in the name of his parents. The petitioner, therefore, made representations before respondents 2 to 5. However, the 2nd respondent is stated to have directed the 5th respondent to examine the request of the petitioner and take necessary action vide Lr.No.D6/93/2014, dated 06-01-2014, which is also reiterated by the 4th respondent under Lr.Ref.No.H/3800/2014, dated 31-08-2014 addressed to the 5th respondent. Alleging that no action is being taken by the 5th respondent in spite of said directions, the present writ petition is filed.

In the circumstances, I deem it appropriate to direct the 5th respondent to examine the representations of the petitioner in the light of the orders already passed by respondents 2 and 4, referred to

above, and after hearing all the parties, take an appropriate decision in accordance with law and send an appropriate report to the 2nd respondent expeditiously.
