THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.31152 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop No.34, Kancherlavaripalli Village, Kanigiri Mandal, Prakasam District. While so, on the basis of the report submitted by the Enforcement Deputy Tahsildar, Kanigiri, the third respondent issued a show cause notice dated 26.06.2015 to the petitioner. The petitioner sought for copy of the report from the third respondent by filing a petition dated 10.07.2015. However, the authorization of the petitioner was suspended by the third respondent by his proceedings dated 28.07.2015 on the ground that the petitioner intentionally did not submit explanation and causing delay in enquiry. The petitioner submitted another petition to the third respondent on 22.08.2015 requesting to furnish the information. Challenging the suspension orders of the third respondent, the petitioner filed an appeal to the second respondent along with stay petition, and when no orders are passed in the stay petition, the present Writ Petition is filed.

3. In view of the pendency of appeal before the second respondent, this Court is not inclined to interfere with the enquiry.

4. In the circumstances, the Writ Petition is disposed of directing the second respondent to take up the appeal and dispose of the same in accordance with law within a period of thirty days from the date of receipt of a copy of this order. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
