The only grievance of the petitioners is that they have succeeded in the suits in OS.Nos.89 to 96 of 1994 on the file of Principal Junior Civil Judge, Kavali, for declaration of right and title against the Government. Basing on the same, they made application to the respondents for issuance of Pattadar Pass Books and Title Deeds in respect of the subject land, by virtue of the said Judgment and Decree in OS.No.89 to 96/94, dated 12.08.1999. As no action is being taken on the said applications, present writ petition is filed. Heard learned counsel for petitioners.
Learned Assistant Government Pleader for Revenue produced written instructions stating that against the Judgment and Decree in OS.Nos.89 to 96/1994, Writ Appeal was preferred and the same is posted for hearing on 05.12.2018.
It is to seen that several other aspects are also raised in the written instructions stating that the land has been taken possession. When petitioners filed application for issuance of pattadar pass book and title deeds, it is for the competent authority to consider the said aspect, instead of keeping the same pending.
In view of the same, the competent authority is directed to consider the application of the petitioner and dispose of the same, in accordance with law, after issuing notice to the petitioners and after hearing the petitioners. Further in the written instructions it is not clear whether any stay is granted by the appellate Court. But, the learned Counsel for the petitioners states that no stay is granted in the appeal. Hence, while disposing the application of the petitioners, the competent authority is directed to consider all these aspects. Accordingly, the writ petition is disposed of. No order as to costs.
