HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8627 of 2015 ORDER:
This criminal petition, under sections 437 & 439 of the Code of Criminal Procedure, is filed by the petitioner-Accused No.1 seeking to grant bail in connection with crime No.36 of 2015 on the file of Rolugunta Police Station, Visakhapatnam, registered for the offences punishable under Sections 20(b) and 25 of the Narcotic Drugs and Psychotropic Substances Act.
The case of the prosecution is that while the Sub-Inspector of Police, Rolugunta Police Station and his staff, were conducting vehicle checking at Nindugonda junction, they found one Bolero vehicle coming from Nindugonda side and on seeing the police, the inmates of the vehicle were tried to escape, but the police apprehended one person. On enquiry, he stated that he is doing ganja business and on 02.04.2015, the petitioner along with the other accused went to Maddigaruvu and purchased 540 kgs., of ganja from the girijans at low price and they wanted to sell it at higher price. Heard and perused the material available on record. A perusal of the record discloses that the seized ganja is about 540 kgs, which is more than the commercial quantity. Hence, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J September 02, 2015 KTL
