THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No.22133 of 2015 ORDER:
The petitioner is doing rice business under the name and style of M/s. M.K. Enterprises situated at Door No.19-4-294/62, Mir Alam Tank, Tadban, Bahadurpura, Hyderabad. While so, the third respondentDeputy Tahsildar (Enforcement) along with other vigilance and enforcement officials came to his shop on 16.06.2015 and found some quantity of rice meant for Public Distribution System and seized the same. Proceedings under Section 6-A of Essential Commodities Act were initiated against the petitioner. The petitioner filed an objection petition before the second respondent on 06.07.2015 requesting for release of the seized stock on furnishing bank guarantee for Rs.2,20,000/- and when no orders were passed by the second respondent, the present writ petition is filed. In the panchanama, the value of the seized stock is shown as Rs.22,000/-.
The petitioner voluntarily agreed to pay an amount of Rs.2,20,000/- through bank guarantee for release of the seized stock. In the circumstances, the second respondent is directed to release the seized stock of the petitioner on furnishing bank guarantee for a sum of Rs.2,20,000/- within two weeks from the date of receipt of a copy of this order.
With the above directions, the writ petition is disposed of. Miscellaneous Petitions, if any pending in this writ petition, shall stand closed. No order as to costs.
