THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRL.RC.MP.No.4902 of 2017 IN/AND CRIMINAL REVISION CASE No.2570 of 2013 COMMON ORDER:

The present Criminal Revision Case is, in fact, filed by the complainant aggrieved over the order dated 23.09.2013 passed in Crl.M.P.No.1016 of 2013 in C.C.No.304 of 2012 on the file of the Judicial Magistrate of First Class-cum-Special Mobile Court, Nizamabad, whereby the request made by the prosecution to summon the Circle Inspector of Police, Nizamabad Town, Nizamabad, to examine him as a witness, was accepted summoning him as a witness, however, subject to condition that the prosecution shall without fail secure his attendance on the next date of hearing, else the petition would automatically stand dismissed.

A perusal of the record discloses that subsequent to passing of the aforesaid order, the Magistrate, by docket order dated 30.09.2013, allowed the aforesaid petition observing that the condition complied, as witness was called present.

Learned counsel for the revision petition would seek permission to withdraw the present Criminal Revision Case.

Even Crl.RC.MP.No.4902 of 2017 is filed by the revision petitioner seeking permission to withdraw the present Criminal Revision Case.

Hence, Crl.RC.MP.No.4902 of 2017 is ordered granting permission to withdraw the present revision case. Consequently, the present Criminal Revision Case is dismissed as withdrawn. As a sequel thereto, miscellaneous petitions, if any pending in the present revision, stand closed.
