HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.37793 of 2018 ORDER:

This writ petition is filed with the following prayer: "...... to issue a appropriate Writ, order or direction, more particularly one in the nature of Writ of Mandamus to declare the action of the respondents in continuing the fraudulent entries in the possession column of the pahani, in the absence of Sale deed or Sada Biname, when the fact of which was revealed in the enquiry conducted vide Rc.No.D/1944/2016 by RDO-R3 under the direction of the collector-R2 to the Survey number 1018 O/1, 1018 OO/1, 1018 AU/1, 1018 O/3, Gts situated in the village of Sujathanagar, Sujathanagar Mandal, Badradri Kothagudem District, is illegal, arbitrary and against the natural principle of justice.

Consequently direct the RDO-R3 to delete the wrongful entries in the possession column of the pahani, in the absence of the Sale deeds or Sada Binama by taking suo motto as the rectification of the pahani come under the jurisdiction in accordance to the section 116-B of the A.P. (T.A.) Land Revenue Act, 1317 Fasli and pass such other order or orders as the Hon'ble Court deem fit and proper and dispose the petition in the interest of justice."

(Reproduced verbatim) Admittedly, the petitioners have alternative remedy by way of revision under Section 166-B of A.P.(Telangana Area) Land Revenue Act, 1317 Fasli (for short "the Act") against the wrong entries made in revenue records. Learned counsel for the petitioners says that the Collector has suo moto revisional

power under Section 166-B of the Act. The affected parties are not made as parties to this writ petition.

In view of the above facts and circumstances of the case, this Court is not inclined to entertain the writ petition. However, since the petitioners have an alternative effective remedy as mentioned supra, this writ petition is disposed of granting liberty to them to avail said remedy and it is expected that the revisional authority will take appropriate action on the application of the petitioners.
