HON'BLE SRI JUSTICE R. KANTHA RAO W.P.No.3770 of 2015 ORDER:
Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 and 2.
This Writ Petition is filed seeking to declare the order dated 30.1.2015 passed by the 2nd respondent in confiscating the entire seized stock, as arbitrary and illegal.
Petitioner is the owner of Godown bearing No.1/1, G.S.Colony. On 22.11.2014, the Assistant Supply Officer, Chevella Division, inspected the godown of the petitioner, and seized the stocks, as he contravened Clause 17 (A) of the Andhra Pradesh State Public Distribution System (Control) Order, 2008.
The petitioner filed a petition before the 2nd respondent-Joint Collector for release of the seized stock. Vide order dated 30.1.2015, the 2nd respondent passed orders confiscating the entire seized stock. Hence, the petitioner filed Crl.A.No.5 of 2015 before the Principal District Judge, Ranga Reddy District, L.B.Nagar and the same is pending.
Since the appeal is pending before the Principal District Judge, Ranga Reddy District, L.B.Nagar, the
learned District Judge is directed to dispose of the interim application filed along with the appeal, within a period of one week from the date of receipt of a copy of this order. Pending disposal of the appeal, there shall be stay of sale of the confiscated stock.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
