HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4720 OF 2015 ORDER:

This criminal petition, under section 438 of the Code of Criminal Procedure, is filed by the petitioners-Accused No.2 seeking grant of anticipatory bail in connection with crime No.367 of 2014 on the file of the Abids Police Station, Hyderabad, registered for the offences under Sections 406 & 420 IPC and 156 (3) Cr.P.C. Heard and perused the material available on record. Originally a private complaint was filed by the de facto complainant against the petitioner for the offence under Section 138 of the Negotiable Instruments Act. Again the de facto complaint lodged the present complaint on the same set of facts for the offences under Sections 406 and 420 IPC.

Learned counsel for the petitioner submitted that the petitioner is willing to furnish suitable security and abide any condition imposed by this Court and ready to cooperate with the investigation. Having regard to the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner. In the circumstances, the petitioner-accused No.2 is directed to surrender before the II-Additional Chief Metropolitan Magistrate, Hyderabad, within ten days from today and on such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for the like sum each to the satisfaction of the said Magistrate. Further, the petitioner is directed to report before the Station House Officer concerned, every day between 10.00 a.m. and 5.00 p.m.

, for a period of (15) days. Accordingly, the Criminal Petition is allowed.
