THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.5031 of 2012 ORDER:

This writ petition is filed by the petitioner herein aggrieved by the action of respondent No.1 impleading him as a party in P.W.No.18 of 2011 before respondent No.3.

2. It is the case of the petitioner that he has nothing to do with the dispute between respondent No.1 and respondent No.2 and he has been unnecessarily impleaded in the said case.

3. Learned counsel for the petitioner states that no application has been filed by the petitioner before respondent No.3 to delete him as a party in the said proceedings.

4. Learned Government Pleader for Labour states that the case P.W.No.18 of 2011 is still pending on the file of respondent No.3.

5. In view of the said submission, the petitioner is given liberty to file an application to delete him as a party in the said case before respondent No.3 within four (4) weeks from the date of receipt of a copy of this order; and

on filing of such application by the petitioner, respondent No.3 is directed to decide the said application within eight

(8) weeks thereafter. Respondent No.3 shall also decide P.W.No.18 of 2011 within three (3) months from the date of receipt of a copy of this order.

6. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

7. Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
