HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.17030 of 2014

ORDER

This writ petition is filed seeking to declare the action of the 3rd respondent in disconnecting the power supply with respect to electricity service connection bearing No.340500009 situated at plot No.26, Industrial Development Area, Kattedan, Ranga Reddy District, as arbitrary and illegal.

The writ petitioners are proprietary firms involved in manufacture of wafers and biscuits. A lease agreement was entered by them with the 4th respondent and the petitioners have been regularly paying municipal tax and the rents and also electricity charges without any delay. While so, on 18.2.2014, the electricity connection to the petitioners' premises was disconnected without any notice. The petitioners came to know that on the complaint given by the 5th respondent on 16.6.2014, the said electricity connection was disconnected.

It appears that there was a claim by the 5th respondent with regard to the property and the husband of the 4th respondent filed O.S.No.938 of 2013 on the file of the III Additional Chief Judge, City Civil Court, Hyderabad, against the 5th respondent and his brother.

While admitting the writ petition on 24.6.2014, this Court directed respondents 2 and 3 to restore power supply to the petitioners' premises on condition that they shall pay all the

arrears and also continue to pay the regular consumption charges and other charges as demanded by the respondents 1 to 3. The said order has been in operation till today.

No counter-affidavit is filed by respondents 1 to 3. In view of the same, this Writ Petition is disposed of making the interim order dated 24.6.2014 passed in WPMP No.21226 of 2014 as final order. However, this order will not prevent respondents 1 to 3 from taking action against the petitioners in case of violation of law, in accordance with law. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 21st October, 2016 rkk
