THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION NO.20325 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to issue writ of mandamus declaring the inaction on the part of the 2nd respondent in considering the representations of the petitioner to remove the 3rd respondent as Mathadipati of Uttaradhi Sri Vaishnav Math, situated at G.Car Street, Tirupati, as illegal arbitrary and consequently direct the 2nd respondent to consider the representations of the petitioner.

2. The case of the petitioner is that the 3rd respondent is alienating the property of Uttaradhi Sri Vaishnav Math, Tirupati, without following the due procedure. He further submitted that the petitioner submitted representations, dated 28-11-2013, 08-07-2014, 19-07-2014, 20-08-2014, 17-10-2014, 07-08-2015, 17-02-2016 and 26-02-2016 to the 2nd respondent. In spite of request of the petitioner, the 2nd respondent is not disposing of the representations submitted by the petitioner.

3. In view of the submission made by the learned counsel for the petitioner, I am not inclined to go into the merits of the main writ petition. The only request of the petitioner is to direct the 2nd respondent to dispose of the representations.

4. Having regard to the facts and circumstances of the case, the 2nd respondent herein is directed to dispose of the representations of the petitioner in accordance with law as expeditiously as possible preferably within a period of two months from the date of receipt of a copy of this order.

5. Accordingly, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending, in this Writ Petition shall stand closed.
