THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.2876 of 2016 ORDER:
The petitioner, who is A2, filed the present application under Section 438 of the Code of the Criminal Procedure (Cr.P.C.), seeking release in the event of his arrest in connection with Crime No.438 of 2015 of Ramachandrapuram Police Station, Medak District, registered for the offences punishable under Sections 419, 420, 468 and 471 of IPC.
The allegations in the report are that one Padmavathi gave a report on 09.09.2015 stating that her husband who is living in New Jersy for the last twenty years, purchased a plot under sale deed dated 04.08.1986 and they are in possession of the same. When she obtained encumbrance certificate, she found to her surprise that the property was sold to one Srinivas Rao in the year 2005 by forging the signature of her husband, though he never visited India in the year 2005. It is further stated that all the accused conspired and executed the said sale deed in favour of one Srinivas Rao, the photo of one Sundaresh was affixed therein and A3 and one Satish Kumar are the alleged attesters of the sale deed. In view of the alleged forgery and cheating committed, the present case came to be registered.
At the time when the matter is taken up for hearing, learned counsel for the petitioner submits that the petitioner is old aged person, lost his vision and as such his request may be considered on certain terms and conditions. But, no documentary evidence is placed on record till today.
notice to the Public Prosecutor, in which event the same shall be dealt with in accordance with law on the same day.
