This criminal petition is filed by the petitioners/accused Nos.3 and 4 seeking enlargement on bail in Crime No.185 of 2025 of Renjal Police Station, Nizamabad District, registered for the offences punishable under Sections 316(5), 318(4) of the BNS and Section 5 of the TSPDFE Act, 1999.

The case of the prosecution is that, on 27.10.2025, the defacto complainant lodged a report before the police stating that about three months ago, on Pedda Balaiah met him and told him to pay Rs.25,000/- to a link named LG (Lucky Generals) (Incorporation Pvt. Ltd.) and he was informed that by watching 16 advertisement videos of 15 minutes each every day, Rs.55/- per video would be credited to the complainant's account. Further, he said that if the complainant managed to join 8 members in that group, he would get Rs.4,000/- and if he joined 15 members, he would receive Rs.8,000/- per month additionally as salary. Believing the same, the complainant joined 15 members, including his family members and other individuals.

Later, Prem Kumar introduced one Jagadeesh to the complainant and both of them conducted a meeting, which was attended by about 150 individuals and they informed the attended people about the above said scheme. All of them joined the said company. Later, complainant's account number was credited with Rs.4,050/- three times. Since then, the complainant has not been receiving any funds to his account and his account has been frozen and when he informed Prem Kumar and Jagadeesh that his account had been put on hold and they gave irrelevant answers. Hence, he requested for necessary action. Basing on the same, the police registered a case for the above said offences.

Heard Sri Peddapally Satyanarayana, learned counsel for the petitioners and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

Learned counsel for the petitioners submitted that the petitioners are innocent of the said allegations and basing on the inducement of accused Nos.1 and 2, their accounts were also closed and they also did not give any amount in the present case and they are in jail since 24.11.2025 and they will co-operate with the investigating officer and prayed the Court to grant bail to the petitioners by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the petitioners herein induced the innocent people by conducting meeting and basing on the same, 150 people joined the said group by investing an amount of Rs.25,000/-. Therefore, the petitioners are not entitled for the bail as other accused are absconding and prayed to dismiss this petition.

Having regard to the submissions made by both the learned counsel and the material on record, the petitioners are in jail since 24.11.2025 and as seen from the record, LWs 1 to 21

witnesses were already examined. Considering the facts and circumstances of the case and also the period of incarceration of petitioners in jail, this Court deems it fit to grant bail to the petitioners subject to the following conditions: i.

The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of learned Additional Judicial First Class Magistrate, at Bodhan.

ii.

The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioners shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
