HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 18898 of 2016 ORDER:
The present writ petition came to be filed with the following prayer:
"Issue a Writ to call for the records pertaining to impugned Notice No.UC/01/TPS/W.No.32/CIR9/WMC/2016, dated 10.05.2016 and the sequel notice No.01/UC/W.No.32/CIR-9/GWMC/2016, dated .06.2016, issued in the name of respondent No.2 by respondent No.3 as patently illegal, arbitrary, high handed; and consequently declare that the respondent Nos.1 to 3 cannot adjudicate upon the questions of title."
When the matter is taken up for hearing, Smt. Pingali Laxmi, learned Standing Counsel for respondent No.2 fairly submits that notice under Section 452 (2) of the H.M.C.Act came to be issued under a misconception of fact situation and as such the same warrant interference.
In view of the submission made by the learned Standing Counsel for respondent No.2, the writ petition is disposed of and the impugned Notice No.UC/01/TPS/W.No.32/CIR-9/WMC/2016, dated 10.05.2016 along with sequel notice No.01/UC/W.No.32/ CIR-9/GWMC/2016, issued in the name of respondent No.2 by respondent No.3 is hereby set aside. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
