HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.23625 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer and his authorization was valid upto 31.03.2016. While so, on 07.06.2015, the fourth respondent seized an auto with PDS rice. On the basis of the confession made by the auto driver, the fourth respondent inspected the shop of the petitioner on the same day and found some variation in stock and initiated 6A proceedings against him. The Revenue Divisional Officer has not taken any action for release of stock. Hence the Writ Petition. It is needless to mention that, so long as the authorization of the petitioner is in force, he is entitled for supply of stock.

However, learned Government Pleader for Civil Supplies has not produced any evidence to show that the petitioner's authorization was suspended, and any action was taken against him. In the circumstances, the Writ Petition is disposed of directing the respondents to release the stock to the petitioner for distribution to the cardholders so long as his authorization is in force.
