HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.2025 of 2014 ORDER:

This revision is preferred challenging the Judgment dated 31-07-2014 passed in Crl.A.No.508 of 2013 by the V Additional Sessions Judge (Mahila Court), Hyderabad, wherein the learned Sessions Judge ordered the petitioner herein to pay maintenance of Rs.10,000/- per month to the 2nd respondent herein towards her maintenance and educational expenses of their children.

The main contention raised by the learned counsel for the petitioner before this Court, without disputing the other facts while passing the order, is that the appellate court passed the order to pay maintenance of Rs.10,000/- per month not only to the 2nd respondent herein but also to their children i.e., one daughter and one son. Now, the undisputed fact is that the daughter was already married and the son also became major. Taking into consideration of the said fact when an order to pay maintenance of Rs.10,000/- is made for three persons through the 2nd respondent herein, necessarily some amount to be deducted as far as the payment to the daughter and son, but the appellate court has not passed an order segregating the amount informing what is the

amount to be paid to the 2nd respondent herein and what is the amount to be paid to the daughter and son concerned. But, this Court is of the view that since the petitioner and the 2nd respondent lived together as husband and wife for a past period of 25 years, the petitioner can be directed to pay a sum of Rs.7,000/- per month to the 2nd respondent herein as her maintenance, deducting Rs.1,500/- towards the maintenance of daughter and Rs.1,500/- towards the maintenance of the son.

Accordingly, the Criminal Revision Case is disposed of directing the petitioner to pay Rs.7,000/- (Rupees Seven thousand only) per month to the 2nd respondent herein towards her maintenance after deducting Rs.1,500/- towards the maintenance of daughter and Rs.1,500/- towards the maintenance of the son.

Miscellaneous petitions pending, if any, in this revision shall stand closed.
