This Criminal Petition is filed by petitioner/accused under Section 482 Cr.P.C seeking to quash the proceedings in C.C.No.66 of 2015 on the file of III Additional Judicial First Class Magistrate, Khammam, where cognizance was taken for the offence punishable under Section 394 I.P.C.

Heard the learned counsel for the petitioner and the learned Public Prosecutor (Telangana) for the State before notice to respondent No.2 and before admission. Perused the material on record.

Undisputedly, charge sheet framed offence under Section 394 I.P.C. besides any circumstantial evidence regarding the occurrence taken place, according to the petitioner though claimed no material and the so called seizure panchanama and disclosure panchanama from the accused is falsely created to maintain a charge sheet, it is submission by the learned Public Prosecutor that from the panchanama once charges are framed and the case is under trial in the track there are no grounds to interfere.

Having regard to the above, this criminal petition is disposed of giving liberty, if at all no grounds to sustain the charge to delete or frame lesser charge, on filing an application even charges also framed under Section 228, by invoking

Section 216 Cr.P.C. for alteration or modification or deletion of the existing charges.
