The present Criminal Petition is filed under Section 482 r/w 457 of Cr.P.C, seeking to direct the respondent to release the Auto bearing No.AP 20 TB 5645, which involved in Cr.No.187 of 2Ol4 of Chintakani on the file of Special Judicial Magistrate of First Class (Prohibition and Excise Cases), Khammam. 2.

Learned counsel for the petitioner fairly submits that the subject matter of the case does not survive. Therefore, seeks to dismiss the Criminal Petition as infructuous. 3.

Mr. Vizarath Ali, learned Assistant Public Prosecutor appearing for the respondent State takes no objection to the same.
