THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.3273 of 2016 ORDER:
This writ petition, filed under Article 226 of the Constitution of India, challenges inaction on the part of the District Collector - 2nd respondent herein, pursuant to the recommendation made by the 4th respondent herein vide letter bearing Ref.No.A/90/2015, dated 01-04-2015.
Heard, Sri V.R. Reddy Kovvuri, learned counsel for the petitioner and learned Government Pleader for Women and Child Welfare for the respondents, apart from perusing the material available before this Court.
The District Collector - 2nd respondent herein vide proceedings Ref.No.A1/710/2014, dated 02-04-2014 placed the petitioner under suspension on certain allegations. Earlier the petitioner herein filed W.P.No.13255 of 2014 before this Court, assailing the validity of the said proceedings of the 2nd respondent. Subsequently, the said writ petition was dismissed as withdrawn on 28-08-2014. Thereafter, the Tahsildar, Badvel - 4th respondent herein, after enquiring into the matter addressed a letter bearing Ref.No.A/90/2015, dated 01-04-2015 to the District Collector, recommending for reinstatement of the petitioner into service.
The grievance obviously in the present writ petition is failure to take action pursuant to the said letter, dated 01-04-2015. Though the petitioner has raised a number of aspects in the affidavit filed in support of the writ petition this Court does
not propose to go into the said aspects in view of the recommendation already made by the 4th respondent herein vide letter, dated 01-04-2015.
In the facts and circumstances of the case, this Court deems it appropriate to dispose of the writ petition with a direction to the 2nd respondent to take appropriate action, as per law, pursuant to the letter bearing Ref.No.A/90/2015, dated 01-04-2015 addressed by the Tahsildar by fixing some timeframe. For the aforesaid reasons, the writ petition is disposed of, directing the 2nd respondent to take appropriate action pursuant to the letter bearing Ref.No.A/90/2015, dated 01-04-2015 addressed by the Tahsildar, Badvel Mandal, in accordance with law, within a period of one month from the date of receipt of a copy of this order. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
