HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CRIMINAL PETITION No.5838 of 2013 ORDER :

The petitioner, in this petition filed under Section 482 Cr.P.C., challenges the order in M.C.No.16 of 2012 on the file of Mandal Executive Magistrate, Vijayawada Urban. A perusal of the impugned order dated 08.08.2012, passed by the learned Mandal Executive Magistrate, Vijayawada Urban would show that having noticed that a suit and writ petition are pending, learned Executive Magistrate closed the proceedings in M.C.No.16 of 2012 with a direction to the parties to settle their rights before the Civil Court and High Court. In view of the aforesaid order being legally impeccable, this Criminal Petition lacks merits for consideration.

Accordingly, this criminal petition is dismissed. As a sequel, pending miscellaneous applications, if any, shall stand closed.
