THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition Nos.31822, 31825, 32030, 32039 & 32202 of 2016 COMMON ORDER:

These batch of writ petitioners are filed seeking a writ in the nature of Mandamus declaring the action of the respondents and their officials in trying to demolish the buildings of the respective petitioners in Yenikepadu village, Vijayawada of Krishna District as being illegal, arbitrary, violative of the provisions of the Constitution of India and principles of natural justice. I have heard the submissions of the learned counsel appearing for the petitioners, and of the learned standing counsel appearing for the 2nd respondent and the 3rd respondent. I have perused the material record. Learned counsel for the petitioners submits that when there was an attempt to demolish the buildings of the respective petitioners, without following the procedure contemplated under law, these batch of writ petitions are filed.

He points out that in the counter affidavit filed on behalf of the 2nd respondent in support of the petition filed for vacating the interim order, it is, inter alia, stated that in the event of a proposal to demolish the buildings of the respective petitioners, the authority would follow the procedure established by law; and, requests that recording the same, the writ petitions may be disposed of.

However, learned standing counsel appearing for the 2nd respondent would submit that the writ petitions are filed on mere apprehensions and that there was never any attempt to demolish the buildings of the respective petitioners and that in the event any action is proposed to be taken against the

buildings of the respective petitioners, the authority would follow the procedure established by law.

Recording the afore-said submissions, all the Writ Petitions are disposed of directing the respondents not to demolish the buildings of the respective petitioners without following the procedure established by law. There shall be no order as to costs.
