ORDER:

The grievance of the petitioner concern was that the respondent authorities were not allowing it to carry on business in Black Jaggery and Alum and were placing restrictions upon its lawful activities.

2. The Prohibition and Excise Inspector, Rampachodavaram, furnished written instructions dated 28.10.2015 to the office of learned Government Pleader for Excise, wherein he categorically stated that the Excise Department had not seized any Black Jaggery from the petitioner concern's premises and no inspection had taken place at the said premises at all.

3. In the light of the aforestated stand of the excise officials, it is clear that the apprehension of the petitioner concern was unfounded. Needless to state, in the event the excise authorities need to interfere with the business activities of the petitioner in terms of the GUR (Regulation of Use) Order, 1968, they would have to abide by the procedure prescribed therein and also the Circular dated 06.11.2013 issued by the Commissioner of Prohibition and Excise, Andhra Pradesh.

Subject to the above observation, the writ petition is dismissed. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR November 3, 2015 Lmv
