HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37820 of 2018 ORDER:

The present writ petition came to be filed seeking issuance of writ of mandamus, declaring the action of respondent Nos.2 and 3 in entering into an agreement with respondent Nos.4 and 5 and trying to confer the benefits, without adjudicating the dispute as per Section 50 of the Andhra Pradesh Capital Region Development Authority Act, 2014 read with Rule 8 of the Andhra Pradesh Capital City Land Pooling Scheme (Formulation and Implementation) Rules, 2015, in spite of the legal notice, dated 04.05.2017, issued by the petitioner in respect of land admeasuring Ac.0.50 cents situated in D.No.101-A, of Nekkallu Village, Thullur Mandal, Guntur District, as illegal and violative of principles of natural justice.

There is no necessity to put the unofficial respondents on notice as this Court is not venturing to adjudicate the issue on merits.

Though various grounds are raised, learned counsel for the petitioner mainly submits that the petitioner has submitted his objections under Section 50 of the Andhra Pradesh Capital Region Development Authority Act, 2014 read

with Rule 8 of the Andhra Pradesh Capital City Land Pooling Scheme (Formulation and Implementation) Rules, 2015 and seeks a direction to the authorities to consider his objections before passing any order. The same is not seriously disputed by the learned counsel appearing for the official respondents. 4.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the second respondent to deal with the objections, if any, submitted by the petitioner under Section 50 of the Andhra Pradesh Capital Region Development Authority Act, 2014, in accordance with law, after hearing all the concerned including the un-official respondents herein.

As a sequel to disposal of the writ petition, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
