THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.35559 of 2015 ORDER:

The petitioner is one of the accused in Crime No.396 of 2015 on the file of Ramachandrapuram Police Station, Ramachandrapuram, Medak District. By way of this writ petition, he seeks a direction to the police authorities to transfer/entrust the investigation of the said crime to the CID or any other independent investigation agency.

The Sub-Inspector of Police, Ramachandrapuram Police Station, Medak District, furnished written instructions to the office of the learned Government Pleader for Home, wherein he stated that Crime No.396 of 2015 was registered under Section 302 I.P.C. read with Section 34 I.P.C. on the file of the said police station. He further stated that upon due investigation, A1, A3, A4 and A5 in the said crime were arrested and remanded to judicial custody. The petitioner is stated to be arrayed as accused No.2 in the said crime and as he was absconding, he could not be subjected to arrest. The investigation is stated to have revealed the involvement of the petitioner. The Sub-Inspector concluded by stating that the investigation was already completed and only the arrest of the petitioner remained to be effected. In the light of the afore-stated facts, the prayer of the petitioner for transfer of the investigation no longer survives as the investigation is stated to have almost concluded.

The writ petition is therefore devoid of merit and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
