THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY Writ Petition No.19371 of 2016 ORDER :

This Writ Petition is filed seeking to declare the action of the 2nd Respondent in not numbering and taking on record the appeal and the interlocutory stay application for interim relief, filed by the petitioner against the proceedings of the 4th Respondent in Case No.B/867/2014, dated 09-06-2016 under Section 6 of the A.P.Land Encroachment Act, 1905, as illegal and arbitrary and consequently, direct the 2nd Respondent to number the appeal and consider the Interlocutory Application filed by the petitioner and pass orders in accordance with law by issuing a writ, order or direction, particularly one in the nature of writ of mandamus.

When the matter is taken up for hearing, the learned counsel for the petitioner states that after filing of this Writ Petition, the appeal has been numbered and as such, the cause in the writ petition does not survive for adjudication. Recording the submission made by the learned counsel for the petitioner, the Writ Petition is dismissed as infructuous. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A. RAJASHEKER REDDY, J.
